The Part A incentive targeted 5 Career and Technical/Special Career Education Tenure Areas. They were Cosmetology, Communications/Media, Trade Electric, General Home and Careers and Guidance Counselors. These positions were targeted due to excessing. At the BOCES board meeting on Wednesday, July 14, 2010 the board will be asked to adopt this incentive for those tenure areas.
In addition after speaking with NYSUT and ESB Administration we have agreed to the following for the members interested in the Chapter 45, 55/25 incentive.
If you want to go out under the Chapter 45, 55/25 you should if you have not already done so, submit a letter of intent to retire under this law to Human Resources. These letters will be held until the August 25th ESB board meeting. At that meeting they will go on the agenda with a stipulation that they are contingent upon the acceptance of the Chapter 45, 55/25 in totality. If the Chapter 45, 55/25 is found to be unconstitutional the members who have submitted those letters and whose name appear on the August 25, 2010 board meeting will have until 3pm on August 31, 2010 to rescind their letters and maintain all of their rights as tenured teachers.
The reason behind working out this agreement is that in case the TRS decides to close the Chapter 45, 55/25 window and only allow those members who have been on board agendas to take advantage of this law and be “grandfathered” in under it.
